Court Denies State’s Motion to Detain Pre-trial a Naperville Man Accused of Shooting Another Man in the Chest

Gun allegedly used in shooting capable of firing as a fully automatic weapon

DuPage County State’s Attorney Robert Berlin and Naperville Chief of Police Jason Arres announced today that Judge Joshua Dieden has denied the State’s motion to detain a Naperville man accused of shooting another man in the chest. Jermaine Badie, 18 (d.o.b. 11/3/2005) of the 700 block of Chesterfield Avenue, appeared in First Appearance Court this morning charged with one count of Aggravated Battery – Discharge Machine Gun and one count of Unlawful Possession of a Machine Gun. Both offenses are Class X Felonies. If found guilty, Badie faces a potential sentence of between twelve to forty-five years in the Illinois Department of Corrections. As a condition of his pre-trial release, Badie will be subject to GPS electronic monitoring.

On October 28, 2024, at approximately 8:48 p.m., the Naperville Police Department received a 911 call for a possible gunshot victim in the 100 block of Testa Drive. Upon their arrival, officers found the victim, lying on his back with blood on his chest and in the surrounding grass, suffering from an apparent gunshot to his chest. He was immediately transported to a local hospital for medical attention. Following further investigation into the shooting, it is alleged that Badie and several other individuals were in the 100 block of Testa Drive when a fight broke out between the victim and another individual. It is alleged that after the fight was over, Badie pulled out a black and silver Glock with a thirty-round extended magazine, threading for a silencer and a switch to convert the firearm into a fully automatic firearm and shot the victim in the chest. It is further alleged that following the shooting, Badie fled the scene. He was found nearby by Naperville police officers a short time later. The bullet allegedly fired by Badie entered through the victim’s chest, a couple inches to the right of his heart, and exited through his back, striking his lung.

“The allegation that Jermaine Badie pulled out a fully automatic weapon and shot a man in the chest following a fight that did not even involve him is outrageous,” Berlin said. “Violent crimes committed with the use of firearms will not be tolerated in DuPage County. Our streets must remain safe, and my office will continue to vigorously prosecute anyone accused of threatening public safety, particularly in cases that involve dangerous weapons, as alleged in this case. I commend the Naperville Police Department for their outstanding work in the identification and apprehension of the defendant in this case. I thank Assistant State’s Attorney Melissa Kravich for her efforts in preparing a strong case against Mr. Badie.”

“Our officers’ quick response to this scene and outstanding field work led to the quick apprehension of the suspect and took a violent and dangerous offender off our streets,” said Chief Arres. “I commend them for their swift actions, our investigators and crime scene technicians for their follow-up, and DuPage County State’s Attorney Bob Berlin’s office for their partnership and guidance.”

Badie’s next court appearance is scheduled for November 25, 2024, for arraignment in front of Judge Ann Celine O’Hallaren Walsh.        

Members of the public are reminded that this complaint contains only charges and is not proof of the defendant’s guilt. A defendant is presumed innocent and is entitled to a fair trial in which it is the government’s burden to prove his or her guilt beyond a reasonable doubt.
